What is faraid and how does it relate to a wasiyyah?
Faraid refers to the fixed shares prescribed by Islamic law for specified heirs. A wasiyyah — a valid Islamic will — governs assets up to one-third of the estate that may be directed to non-heirs or for other purposes. Both instruments work together, and understanding how they interact within the Malaysian legal framework is a central part of our Will and Faraid Advisory engagement.
Do I need a separate Islamic will if I already have a conventional will?
For Muslim clients in Malaysia, a conventional civil will does not govern assets that fall under faraid. The two instruments operate in parallel — one through the civil courts and the other through the Shariah court. Our advisory engagement reviews the full picture so both sides are properly accounted for.
What types of transactions does the Islamic Finance engagement cover?
The engagement covers Shariah-compliant financing structures — including murabahah, ijarah, musharakah, and sukuk issuances — at both the documentation and structuring advisory stages. We work alongside the client's conventional legal and finance teams and coordinate with the Shariah committee where required.
How long does a typical Will and Faraid Advisory engagement take?
Most engagements are completed within three to five weeks from the initial consultation. The timeline depends on the complexity of the estate, the number of dependants, and whether religious council registration is required. We set out the expected timeline at the start of each engagement.
Is the Comprehensive Programme suitable for individuals or only for businesses?
The programme is designed for individuals, families, and family offices as well as businesses with ongoing Shariah-related requirements. The structured touchpoints can be calibrated to the complexity of the client's situation, whether that involves estate matters, takaful, waqf, or Islamic banking arrangements.
Are consultations held in person at your Putrajaya office?
We see clients at our Putrajaya office and can also arrange remote consultations where that is more convenient. For engagements involving document signing or religious council submissions, in-person attendance will be required at the relevant stage.
